TERMS AND CONDITIONS OF USE

1. General Provisions and Legal Status

1.1. This equipment auction platform (hereinafter referred to as the “Platform”) is an integral part of the traktor.az project. The Platform is a digital trading platform that provides for the sale of agricultural, construction and other special-purpose equipment by online auction. 1.2. The Platform’s activities are regulated by the Civil Code of the Republic of Azerbaijan, the Law of the Republic of Azerbaijan “On Electronic Commerce” and other relevant regulatory legal acts. 1.3. By using the Site, the User unconditionally accepts the terms of these Rules.

2. Participant Registration and Verification

2.1. Registration is mandatory to participate in auctions. The user is responsible before the Azerbaijani legislation for the accuracy of the information provided during registration (name, surname, contact information, TIN if a legal entity, etc.). 2.2. The platform reserves the right to request additional identification documents or a bank guarantee from the user, especially for high-value auctions.

3. Bidding Rules

3.1. Non-Revocation of Bids: In accordance with the provisions of the Civil Code of the Republic of Azerbaijan on holding auctions, each bid placed on the Platform is considered an expression of the will of the participant and cannot be withdrawn until the end of the auction. 3.2. Auction Extension: If a bid is placed 2 minutes before the end of the auction, the auction period may be automatically extended by a specified time in order to maintain the transparency of competition. 3.3. Statuses:

  • Active Current auctions open for bids.
  • Closed: Auctions that have expired and the winner has been determined.

4. Состояние оборудования и принцип «как есть».

4.1. All equipment is sold “as is”. This means that the seller is not responsible for any hidden or obvious defects in the equipment, unless such information has been intentionally concealed. 4.2. Before submitting a bid, participants should examine the technical passport and, if possible, conduct a physical inspection of the equipment.

5. Payment and Transfer of Title

5.1. The purchase and sale agreement between the winning participant and the Platform (or the owner of the equipment) is formalized in accordance with the legislation of the Republic of Azerbaijan. 5.2. Failure to make payment by the winner within the specified period (usually 3-5 banking days) is considered a breach of obligations, and in this case the “Declaration” (Beh) amount is not refunded. 5.3. The ownership of the equipment is transferred to the winner only after full payment is made and state registration is formalized (for example, in the State Technical Supervision Service under the Ministry of Agriculture).

6. Liability of the Parties and Dispute Resolution

6.1. The Platform is not responsible for technical errors, Internet provider outages, or force majeure. 6.2. All disputes arising from these Rules shall be resolved through negotiations, and if no agreement is reached, by the relevant courts of the Republic of Azerbaijan. 6.3. If abuse of the Platform (for example, artificial price increases, fake profiles) is detected, the user's account will be immediately blocked and the information may be provided to law enforcement agencies.

7. Final Provisions

7.1. traktor.az has the right to unilaterally change these Rules at any time. The changes come into force from the moment of their publication on the site.
